Fertilisers

Only EU fertilising product and a fertiliser entered in the register of fertilisers may be imported to Estonia and distributed. Fertiliser must comply with the requirements of the relevant EU legislation, Fertilisers Act and legislation established on the basis of the Fertilisers Act.

Fertiliser handling in the sense of the Fertilisers Act is the production, packaging, marking and import of a fertiliser into Estonia for distribution purposes, and the distribution of a fertiliser. A legal person, self-employed person or a state agency or a local authority agency may be the handler of a fertiliser.

To handle a fertiliser, a notice of economic activity must be submitted to the Agriculture and Food Board. A handler who purchases or in any other manner acquires the fertiliser from another handler who has already submitted a notice of economic activities regarding the fertiliser does not need to submit a notice of economic activities.

The notice of economic activities can be submitted electronically through the Customer Portal or on paper to the Plant Protection and Fertiliser Department of the Agriculture and Food Board. The notice must be signed by a member of the management or authorization of the company. If not then the copy of the power of attorney is needed.  In the case of foreign companies the extract from the business register is needed.

In addition to the notice the test protocol that concerns the results of the analysis of a test sample of the fertiliser issued by a laboratory accredited for application of the relevant analytical methods accredited, or a relevant document (certificate) regarding the composition of the fertiliser, issued by the producer, must be submitted.

A handler based on whose notice of economic activities the data is entered in the register of fertilisers pays the state fee charged for the acts of supervising the conformity of the fertiliser in the year of commencement of the handling of the fertiliser upon submission of the notice of economic activities and in each subsequent calendar year by 10 January until termination of the handling of the fertiliser.

The amount of the state fee depends on the size of the package of the fertiliser: 10 euros until the package size 25 kg or L and 160 euros for package size more than 25 kg/L. If the notice of economic activity is sent by email or regular mail (not via Client Portal) then state fee of 10 euros will be added to each fertiliser (State Fees Act article 345). The state fee for the supervisory activities is also 10 or 160 euros for one fertiliser every year.

If the handler has not paid by 10 January of the current year the state fee charged for the acts of supervising the conformity of the fertiliser entered in the register of fertilisers on the basis of the handler’s notice of economic activities, the handling of the fertiliser is deemed as terminated and the data entered in the register of fertilisers regarding the fertiliser are declared invalid.

State Fees Act § 26125  

For supervision operations regarding conformity of fertilisers entered in the register of fertilisers on the basis of a notice of economic activities, a state fee shall be paid in the amount of 10 euros in the year of starting the handling of fertilisers packaged in packaging of up to 25 kilograms or 25 litres, and in the amount of 160 euros in the year of starting the handling of fertilisers packaged in packaging of over 25 kilograms or 25 litres, upon submission of the notice of economic activities and each subsequent calendar year up to the end of handling of the same fertiliser. If a fertiliser is distributed in packaging of varying sizes, the state fee shall be paid on the basis of the largest packaging.
